Compensation
The damages cap explained. For claims accruing on or after January 1, 2025, Colorado law is understood to cap non-economic damages at $1,500,000, with inflation adjustments beginning in 2028, subject to attorney confirmation of the current figure and effective date. Economic damages are generally not subject to that cap, no matter how high the medical bills or lost income run. Punitive damages may be available separately when a defendant acted with fraud, malice, or willful and wanton disregard for others.
