  • Colorado requires eye protection for every rider regardless of age (C.R.S. 42-4-232), and helmets only for riders under 18 (C.R.S. 42-4-1502). Both choices can be weaponized by an insurer as a "failure to mitigate" argument that cuts your compensation.
  • Lane filtering became legal on August 7, 2024 under SB24-079 (C.R.S. 42-4-1503), but only when traffic is completely stopped, not just slow. Insurers routinely mislabel legal filtering as illegal splitting to deny Centennial riders' claims.
  • Colorado's modified comparative negligence rule can reduce your recovery by your share of fault and bar your claim entirely if your share reaches 50 percent or more (C.R.S. 13-21-111). Adjusters inflate that percentage against riders.

CGH Injury Lawyers serves injured motorcyclists throughout Centennial and Arapahoe County from our Denver office at 2701 Lawrence St., Suite 201. We know how insurers use Colorado's gear and lane-filtering rules against riders, and we build the evidence that defeats those arguments. Free first consultation, no fee unless we win.

Who we represent

Centennial riders we represent, and the ones we turn away

We take the cases we can stand behind, and we tell you honestly when we cannot. That policy protects you from burning time on a claim that is not going anywhere, and it keeps us focused on riders we can actually help.

Riders we represent

  • Riders struck by drivers on I-25, Parker Road (SH 83), Arapahoe Road (SH 88), E-470, or C-470 in or near Centennial
  • Riders injured in the I-25/Arapahoe Road interchange corridor, one of Arapahoe County's highest-crash-rate intersections
  • Riders hit by drivers making left turns, running red lights, or failing to yield in Centennial's high-volume commuter corridors near the Denver Tech Center
  • Riders whose injuries were worsened by Centennial road hazards, including black ice on elevated interchanges overnight and early morning
  • Families of riders killed in fatal Centennial or Arapahoe County crashes who are pursuing a wrongful death claim

One thing we will tell you straight

  • We do not take every motorcycle case. If our free review shows that your share of fault likely reaches 50 percent or more, we will say so clearly and explain why, instead of stringing you along.
  • We do not have a Centennial office. We serve Centennial riders from our Denver office at 2701 Lawrence St., Suite 201, Denver, CO 80205. Any firm claiming a local Centennial address should be asked to verify it.
  • We do not publish settlement figures for motorcycle cases, because every injury is different and a dollar amount on a page tells you nothing accurate about your case.
The 2026 legal guide

Colorado motorcycle laws that decide your Centennial claim

Colorado motorcycle law changed in August 2024 with the legalization of lane filtering. Riding by the old rulebook, or letting an insurer misrepresent the new rules, can cost Centennial riders thousands of dollars in reduced compensation. Here is what actually controls your case.

Helmets: C.R.S. 42-4-1502

  • Riders and passengers under 18 must wear a DOT-compliant helmet.
  • Riders 18 and older may legally ride without a helmet in Colorado.
  • Legal does not mean consequence-free. Defense attorneys use the no-helmet choice to argue a rider "failed to mitigate" the severity of injuries, pressing for a reduced settlement.

Eye protection: C.R.S. 42-4-232

  • Every rider and passenger, regardless of age, must wear glasses, goggles, or a face shield, unless a compliant windscreen is fitted.
  • A violation is a Class A traffic infraction. Insurers cite it as evidence your own conduct contributed to your injuries.
  • If you received a citation after a crash, consult an attorney before speaking with any insurer.

Lane filtering: C.R.S. 42-4-1503

  • Legal since August 7, 2024, under SB24-079, but only when traffic is completely stopped, not slow-moving.
  • The motorcycle must travel at 15 mph or less, on a road with at least two adjacent same-direction lanes, without exceeding the posted speed limit.
  • Lane splitting, riding between lanes of moving traffic at speed, remains illegal in Colorado. Insurers routinely mischaracterize legal filtering as illegal splitting on Centennial's multi-lane roads.

Class M endorsement

  • Operating a motorcycle in Colorado requires a valid Class M endorsement, earned through a written test and on-cycle skills test.
  • Riding without a valid endorsement can lead to criminal charges and gives an insurer grounds to dispute your claim on a negligence-per-se theory.

Filtering vs. splitting: the difference that decides your Centennial claim

Arapahoe Road (SH 88) carries three lanes in each direction through Centennial, and I-25 and Parker Road (SH 83) are equally wide. Stopped-traffic filtering at those intersections is legal under C.R.S. 42-4-1503, but an adjuster's first move is to ask whether you were filtering or splitting, and at what speed. If you were going 20 mph, or if traffic was only moving slowly rather than stopped, the insurer will argue you broke the law. Dashcam footage, traffic-signal data, and witness statements are how we prove what actually happened. We move quickly to lock that evidence down because it disappears fast.

Local knowledge

Centennial roads, courts, and trauma care: the ground a motorcycle claim stands on

A motorcycle crash in Centennial plays out on specific roads, goes through a specific courthouse, and sends injured riders to specific trauma centers. Here is the ground we work on for every Centennial case.

Courthouse

Arapahoe County District Court

Personal injury cases arising in Centennial are filed in the 18th Judicial District at the Arapahoe County Justice Center, 7325 S. Potomac St., Centennial, CO 80112. The courthouse is in Centennial itself, and the judges and opposing counsel know the local defense firms. We appear in Arapahoe County District Court for Centennial clients directly from our Denver office.

Trauma Care

HCA HealthONE Swedish (Level I)

The closest Level I trauma and burn center to Centennial is HCA HealthONE Swedish (Swedish Medical Center) at 501 E. Hampden Ave., Englewood, CO 80113 -- a state-designated Level I trauma center minutes from I-25. Riders with the most critical injuries from Centennial crashes are typically transported here. Those medical records form the backbone of your damages claim, and we request them immediately after engagement.

Trauma Care

AdventHealth Littleton (Level II)

AdventHealth Littleton, 7700 S. Broadway, Littleton, CO 80122, holds an American College of Surgeons verified and state-designated Level II trauma designation. Many Centennial motorcycle accident victims, particularly those injured on the southern and western edges of the city near C-470, receive initial care here. Medical record continuity across both facilities matters for documenting the full scope of injuries.

High-Risk Roads

I-25 / Arapahoe Road interchange

CDOT and Arapahoe County have documented a historically high accident rate at the I-25 and Arapahoe Road interchange, with official records noting emergency responder access difficulties. The interchange serves as a major gateway into Centennial's Denver Tech Center corridor, and peak commuter hours generate the congestion that puts motorcycles at highest risk from lane-change and merge collisions.

High-Risk Roads

Parker Road (SH 83) safety concerns

A CDOT safety and operations analysis of SH 83 identifies narrow paved shoulders, numerous access points, steep side slopes, wildlife crossings, and high traffic growth as documented crash-contributing factors along Parker Road through Centennial. For motorcyclists, narrow shoulders eliminate the margin for error that car drivers take for granted, and the documented access-point density creates repeated risk of left-turn collisions.

Road Hazard

Black ice and the hail belt

Centennial sits in Colorado's high-elevation hail belt, with an active severe weather season from March through October and documented severe weather warnings. Black ice forms when melted snow refreezes overnight, and it is particularly dangerous on the elevated I-25, SH 83, and SH 88 corridors through Centennial. When road conditions contributed to your crash, the claim may extend beyond the at-fault driver to other responsible parties. That analysis starts at the free case review.

Why CGH

Why Centennial motorcycle accident victims choose CGH Injury Lawyers

We do not have a Centennial office and we will not pretend otherwise. What we have is a trial-ready team at 2701 Lawrence St., Suite 201, Denver, CO 80205 that handles Arapahoe County cases every week, and a policy of telling you things that other firms might soften.

The Law

We know C.R.S. 42-4-1503 cold.

Lane filtering went legal in August 2024. Most adjusters still use it against riders. We have already beaten that argument for Colorado motorcyclists.

One Refusal We Make Publicly

We do not take cases we cannot stand behind.

If the free review shows your share of fault likely reaches 50 percent or more under C.R.S. 13-21-111, we will tell you that clearly in the first call. We do not sign riders up to generate paperwork. Every Centennial motorcycle case we accept is one we genuinely believe we can move forward.

18th Judicial District

Arapahoe County courtroom-ready.

We try cases in the Arapahoe County Justice Center at 7325 S. Potomac St. when insurers will not negotiate fairly. Trial readiness is what drives fair settlements before trial.

Trial Pedigree

ABOTA advocate on the team. 25+ verdicts.

Managing Partner Kevin Cheney is a member of the American Board of Trial Advocates and has tried over 25 cases to verdict. Timothy G. Tarr has been recognized by Best Lawyers every year since 2023. Insurers treat those credentials differently in a negotiation.

Evidence First

We move fast on the crash evidence.

On Centennial's high-volume corridors, dashcam footage gets overwritten, traffic-camera data gets purged, and witnesses forget. We issue preservation requests immediately after you engage us. On cases involving the documented crash zones at I-25/Arapahoe Road or SH 83, that speed is the difference between a provable case and an unprovable one.

Bilingual

Hablamos espanol.

Spanish-speaking attorneys and staff serve Centennial's Spanish-speaking riders and families throughout the case.

No Win, No Fee

Contingency only.

You pay nothing for legal fees out of pocket. We advance costs and collect only if we recover for you.

After the crash

What to do after a motorcycle accident in Centennial

The steps you take in the hours and days after a Centennial crash determine what evidence survives. Here is the path we walk with you.

  1. Call 911 and get medical care

Report the crash immediately. Serious injuries may send you to HCA HealthONE Swedish (Level I) or AdventHealth Littleton (Level II). Even minor-seeming injuries can mask internal trauma -- get examined the same day and keep every record.

  2. Document the scene before leaving

Photograph the crash site, all vehicles, your injuries, and any road conditions that may have contributed. Identify the at-fault driver's insurance, license plate, and contact information. Get the names of any witnesses. On I-25 or SH 83, nearby businesses or CDOT cameras may have recorded the crash.

  3. Do not speak to the at-fault driver's insurer

The at-fault insurer will call quickly. Do not give a recorded statement, accept an early offer, or sign anything before consulting an attorney. Early offers are designed to settle your case for less than it is worth, before the full extent of your injuries is known.

  4. Call CGH and start a free case review

Call (303) 209-9395 or submit the form on this page. We will review the crash facts, explain your rights, and tell you honestly whether we can help -- at no cost and no obligation.

  5. We preserve the evidence immediately

We send preservation letters to all parties, subpoena dashcam and traffic-camera footage, lock down the crash report from Arapahoe County, and engage accident reconstruction experts when the facts require it. On Centennial's corridors, this work happens fast or it does not happen at all.

  6. We build the claim and negotiate for trial

We document every economic loss, build the medical record, defeat the rider-blame arguments, and send a demand to the insurer. Most cases settle. When they do not, we file in Arapahoe County District Court and try your case.

Compensation

What a Centennial motorcycle accident victim can recover

Colorado recognizes two categories of damages in a motorcycle accident claim. Which ones you can recover, and how much, depends on fault, the severity of your injuries, and the applicable statutory caps.

Economic damages (never capped)

  • Emergency transport and hospital care, including air transport to HCA HealthONE Swedish
  • Surgery, intensive care, and follow-up treatment
  • Long-term rehabilitation, physical therapy, and home care
  • Lost wages during recovery
  • Lost future earning capacity if injuries prevent returning to your previous work
  • Motorcycle replacement or repair
  • Out-of-pocket expenses tied to the crash

Non-economic damages (capped, with exceptions)

  • Pain and suffering
  • Emotional distress and anxiety
  • Loss of enjoyment of life
  • For claims accruing on or after January 1, 2025, non-economic damages are capped at $1.5 million under C.R.S. 13-21-102.5, with inflation adjustments starting in 2028.
  • Compensation for physical impairment and disfigurement is not capped at all under C.R.S. 13-21-102.5(5) -- which often makes it the largest line in a serious motorcycle injury case.

How Colorado's comparative fault rule cuts your recovery

Colorado follows modified comparative negligence with a 50 percent bar (C.R.S. 13-21-111). If you are found less than 50 percent at fault for your injuries, you recover damages reduced by your share of fault. If your share reaches 50 percent or more, you recover nothing. Insurance adjusters routinely inflate a rider's fault percentage, particularly on Centennial's documented high-crash corridors where conditions, not rider behavior, are often the real cause. Fighting that number is a central part of every case we take.

Defense tactics

Defenses insurers use against Centennial riders, and how we defeat them

Every defense below is a tactic we have seen deployed against Colorado motorcyclists. Knowing what is coming is the first step to stopping it.

  1. The no-helmet "failure to mitigate" argument

Riders 18 and older break no law riding without a helmet (C.R.S. 42-4-1502). Defense attorneys still argue the rider "failed to mitigate damages" and is partly responsible for the severity of head or facial injuries. The argument attempts to assign comparative fault, cutting the overall recovery. We challenge that defense with medical evidence tying the injury to the collision itself, not to the absence of a helmet.

  2. Illegal lane splitting claim against a legal filterer

Since August 2024, filtering stopped traffic at 15 mph or less is legal under C.R.S. 42-4-1503. Lane splitting, moving between lanes of traffic that is moving at speed, is still illegal. Insurers in Centennial cases, particularly on multi-lane SH 88 and I-25, have denied claims by characterizing legal filtering as illegal splitting. Dashcam footage, witness accounts, and traffic-signal data establish what was actually happening.

  3. Eye protection and license violations as evidence of negligence

A Class A infraction for riding without eye protection (C.R.S. 42-4-232), or operating without a valid Class M endorsement, can be turned into negligence-per-se evidence. If you received a citation after the crash, we need to review it before you speak to any insurer. Citations issued at a crash scene are not admissions of fault for the collision.

  4. Speed inflation on high-limit roads

I-25 and the Centennial corridors carry posted limits of 55 to 65 mph. Insurers sometimes accept or encourage reconstructions that overstate a rider's pre-crash speed, inflating the rider's comparative fault percentage. We retain qualified accident reconstruction experts to challenge those numbers with actual physical and electronic evidence from the scene.

Coverage and UM/UIM

Insurance issues every Centennial rider should understand

A serious crash on I-25 or Parker Road can generate medical bills that run well past Colorado's minimum liability limits. Understanding where the money comes from is not optional in a motorcycle case.

Colorado minimum liability limits

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury, total
  • $15,000 per accident for property damage
  • When a motorcycle crash generates $200,000 or more in medical bills, minimum limits leave the rider severely undercompensated without UM/UIM coverage.

UM/UIM coverage: why it matters for Centennial riders

  • Uninsured/underinsured motorist (UM/UIM) coverage pays when the at-fault driver has no insurance or limits that fall short of your actual damages.
  • Colorado insurers must offer UM/UIM coverage, though you can decline it in writing. We strongly advise against declining it, particularly for motorcyclists.
  • Colorado UM/UIM claims are governed by C.R.S. 13-80-107.5 under Pham v. State Farm, 2013 CO 17.
  • Without UM/UIM coverage and facing an uninsured driver, suing the individual directly is often impractical when the driver has no assets to reach.

Frequently asked questions

Centennial motorcycle accident: frequently asked questions

Where is a Centennial motorcycle accident lawsuit filed?

Personal injury cases arising in Centennial are filed in the 18th Judicial District at the Arapahoe County District Court, located at the Arapahoe County Justice Center, 7325 S. Potomac St., Centennial, CO 80112. Most motorcycle accident claims settle before a lawsuit is filed, but knowing which courthouse governs your case affects local procedures and the litigation environment. CGH appears in Arapahoe County District Court directly.

How long do I have to file a motorcycle accident claim in Colorado?

Colorado gives you three years from the date of the crash to file a lawsuit for injuries arising out of the use or operation of a motor vehicle (C.R.S. 13-80-101(1)(n)). Shorter deadlines can apply. Most non-vehicle injury claims must be filed within two years under C.R.S. 13-80-102(1)(a). Claims involving a government vehicle or public entity require a written notice within 182 days of discovering the injury (C.R.S. 24-10-109). Get your specific deadline confirmed with an attorney as early as possible.

Is lane filtering legal on Arapahoe Road and Parker Road in Centennial?

Lane filtering became legal in Colorado on August 7, 2024, under SB24-079 (C.R.S. 42-4-1503), but only under specific conditions: traffic must be completely stopped, the motorcycle must travel at 15 mph or less, and the road must have at least two adjacent same-direction lanes. Arapahoe Road (SH 88) and Parker Road (SH 83) through Centennial qualify for filtering geometry, but the traffic-stopped requirement is strict. Slow-moving traffic does not qualify. If an insurer is disputing whether your filtering was legal, we analyze dashcam footage and traffic-signal data to establish what conditions actually existed.

Does not wearing a helmet bar a Centennial rider from recovery?

No. Riders 18 and older are not required to wear a helmet under C.R.S. 42-4-1502. You are not barred from filing a claim for riding without one. However, the defense will likely argue that the absence of a helmet contributed to the severity of your head or facial injuries, attempting to assign comparative fault and reduce your recovery. Colorado's modified comparative negligence rule (C.R.S. 13-21-111) reduces your award by your percentage of fault, so challenging that argument is critical in cases involving head injuries.

Is there a cap on motorcycle accident damages in Colorado?

Economic damages (medical bills, lost wages, future care costs) are never capped. Non-economic damages (pain and suffering, emotional distress) are capped at $1.5 million for claims accruing on or after January 1, 2025, under C.R.S. 13-21-102.5, with inflation adjustments starting in 2028. Compensation for physical impairment and disfigurement is not subject to that cap at all under C.R.S. 13-21-102.5(5). Lower, inflation-adjusted caps apply to older claims based on when the claim accrued.

What if the at-fault driver had no insurance or minimal coverage?

Your own uninsured/underinsured motorist (UM/UIM) coverage is typically the answer when the at-fault driver is uninsured or underinsured. Colorado UM/UIM claims are governed by C.R.S. 13-80-107.5 under Pham v. State Farm, 2013 CO 17. Colorado insurers must offer UM/UIM coverage, though you may have declined it in writing. We confirm every policy in play before advising you on your options.

How does Centennial's I-25/Arapahoe Road interchange affect a motorcycle crash claim?

The I-25/Arapahoe Road interchange has a documented high accident rate recognized in CDOT and Arapahoe County records, including noted difficulties with emergency responder access. If your crash occurred in or near this corridor, that documented history can support your claim that road design or traffic conditions contributed to the collision. We use official crash data, CDOT records, and engineering analysis to establish what conditions existed at the scene.
