Windsor Bus Accident Lawyers Who Beat the 182-Day Deadline

Three restrictions that do not apply to ordinary injury cases

• Strict notice requirement. You must file a formal Notice of Claim within 182 days of discovering your injury (C.R.S. 24-10-109), far shorter than the standard statute of limitations.
• Damage caps. Colorado law sets statutory limits on what you can recover from a public entity, no matter how severe your injuries are.
• Limited discovery. Government entities carry certain procedural protections during investigation and litigation that private defendants do not have.

Where the higher standard applies

• Sudden stops and starts. Jerk-and-jolt injuries happen when a bus brakes or accelerates abruptly and throws standing passengers to the floor, even when the driver hit nothing.
• Door closures. Closing doors on a passenger trying to board or exit, without verifying clearance, can violate the duty of care.
• Failure to secure mobility devices. Wheelchair users and riders with mobility aids are entitled to proper securement before the bus moves.
• Inadequate weather precautions. In Windsor winters, operators are expected to salt steps, allow extra boarding time, and adjust to conditions.

Because of this standard, you do not have to prove recklessness or extreme carelessness. You only have to show the operator failed to exercise the extraordinary care the law requires of common carriers, which often makes negligence easier to establish than in an ordinary car crash.

Windsor also carries hazards that bear on transit crashes. The Town's August 2025 roadway safety summary counts an average of 332 crashes a year, 37 of them with an injury or death, with 303 crashes and no fatal crash in 2024; ten crashes killed someone in the last ten years, six of them vehicle-only, three involving motorcycles and one a pedestrian, and people walking, biking, or riding motorcycles were 4 percent of crashes but 60 percent of the deaths. The Vision Zero plan, adopted by Resolution 2025-29 with a goal of zero deaths and severe injuries by 2035, says Windsor has doubled in population over the last decade, and the Census Bureau puts it at 43,840 as of July 2025, up from 32,714 in 2020. The 2020 plan found daily volumes at three major intersections up 43 percent over its study period with crashes up 42 percent, flagged truck traffic on Main Street that a bypass would only partly relieve, and CDOT projected traffic on SH 392 over I-25 rising from 18,900 to 44,300 vehicles a day by 2035 when it rebuilt that interchange in 2012. The Town plows 273 center-lane miles with arterials, school bus routes, and emergency routes first. Each of these facts can shape who is liable and what evidence matters.

In transit cases, agencies often argue that a passenger was not holding a handrail during a sudden stop, that a pedestrian crossed against the signal or outside a crosswalk, or that a rider distracted the driver. Even so, you may still recover as long as the operator shares fault. A passenger who falls during a sudden stop might be 20 percent at fault for not holding on, yet still recover 80 percent of the damages if the driver violated the common carrier standard. • When a public entity operated the bus, recovery comes through the entity under the CGIA, subject to the $505,000 per person and $1.42 million per incident caps (C.R.S. 24-10-114).
• When a private contractor operated the route, its commercial general liability insurance often carries much higher limits, and the CGIA caps may not apply.
• When another vehicle helped cause the crash, that driver's insurer can be a separate source, and it is not subject to the CGIA caps.
