The filing deadline and comparative fault

Colorado UM/UIM claims are governed by C.R.S. 13-80-107.5, the statute the Colorado Supreme Court applied in Pham v. State Farm, 2013 CO 17. The deadline turns on the procedural history of the underlying claim. Your policy may also impose a shorter contractual notice deadline. Missing that notice can give the insurer a defense, so it must be identified early.

Colorado follows a modified comparative negligence rule with a 50 percent bar (C.R.S. 13-21-111). If you are found less than 50 percent at fault, you recover damages reduced by your percentage of fault. If you are 50 percent or more at fault, you recover nothing. The City is rebuilding that northern arterial right now. Its Federal Parkway Improvements Project covers West 120th Avenue to West 122nd Avenue, where the road currently carries two travel lanes in some segments and four in others, and the City says construction began in 2026. A corridor moving between two lanes and four is exactly where merges surprise drivers.

Wadsworth Parkway shows up on the same construction page for hardware rather than pavement. The City lists a State Highway 121 signal improvement project at five intersections, naming 90th Avenue, 94th Avenue, Independence Drive, 100th Avenue, and 101st Avenue, and covering new signal equipment, poles, pedestrian crossing improvements, and vehicle detection.

Roadwork does not settle a UM claim. Everything turns on whether the driver who hit you carried a policy that pays.

Signals and Who Holds the Timing

Two agencies run the lights in one city

The City states that Westminster maintains and operates over 100 traffic signals on city and state roadways within the city limits, and that the state transportation department maintains and operates the signals on Wadsworth Parkway, 120th Avenue, and Federal Boulevard. Those are three of the corridors named above.

That division matters in a left-turn or red-light dispute, because the agency operating the signal is the one holding the phasing and timing information. We identify the right custodian early rather than after the record has aged.

The Colorado Department of Public Health and Environment's published list of designated trauma facilities carries St Anthony North Hospital at Level III, at 14300 Orchard Parkway with a Westminster address. The hospital's own material describes it as a Level III Trauma Center as well.

Each of the counties Westminster sits in has a higher designation of its own on that same list. On the Adams County side, HCA HealthONE Mountain Ridge at 9191 Grant Street in Thornton is Level II.
